1. Agreement to Terms

By accessing or using CampaignKit's email verification and validation services (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Services.

These Terms apply to all users of the Services, including without limitation users who are browsers, customers, merchants, and/or contributors of content.

2. Description of Services

CampaignKit provides email verification and validation services that allow you to:

• Verify the validity and deliverability of email addresses
• Detect disposable, temporary, and malicious email addresses
• Clean email lists to improve email campaign deliverability
• Find and verify email addresses for business contacts
• Integrate with third-party platforms (HubSpot, Mailchimp, etc.)

3. Account Registration and Security

3.1 Account Creation

To access certain features of the Services, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

3.2 Account Eligibility

You must be at least 18 years old to use the Services. By agreeing to these Terms, you represent and warrant that you are at least 18 years of age.

4. Acceptable Use Policy

4.1 Permitted Use

You may use the Services only for lawful purposes and in accordance with these Terms. You agree to use the Services for legitimate email verification purposes, such as:

• Validating opt-in email addresses for marketing campaigns
• Cleaning your own email lists
• Verifying business contact information
• Improving email deliverability for your organization

4.2 Prohibited Use

You agree NOT to use the Services for any of the following prohibited activities:

• Spam: Sending unsolicited bulk emails or facilitating spam operations
• Reselling Email Lists: Creating, maintaining, or selling email lists without proper consent
• Scraping: Using the Services to scrape, harvest, or collect email addresses from websites without authorization
• Malicious Activities: Using the Services for phishing, fraud, identity theft, or other criminal activities
• Harassment: Using verified email addresses to harass, abuse, or harm individuals
• Violation of Laws: Using the Services in any manner that violates applicable laws, including CAN-SPAM Act, GDPR, or other anti-spam regulations
• System Abuse: Attempting to bypass rate limits, access restrictions, or security measures
• Reverse Engineering: Attempting to reverse engineer, decompile, or extract the underlying algorithms of the Services
• Automated Access: Using bots, scrapers, or automated tools to access the Services outside of our official API

4.3 Compliance with Anti-Spam Laws

You represent and warrant that your use of the Services complies with:

• CAN-SPAM Act (United States)
• General Data Protection Regulation (GDPR) - EU
• Canadian Anti-Spam Legislation (CASL)
• All other applicable anti-spam and data protection laws

5. Pricing and Payment

5.1 Free Tier

CampaignKit offers 25 free email validations. No credit card or payment details are required to access the free tier.

5.2 Paid Plans

Paid plans are available on a monthly subscription basis or as one-time purchases. Current pricing and plan details are available at campaignkit.cc/pricing.

• Monthly Plans: Billed monthly with recurring charges until cancelled
• One-Time Access: Single payment for 14-day access to the Services
• API Credits: Pay-as-you-go credits that do not expire

5.3 Payment Terms

• All fees are charged in US Dollars (USD) or Euros (EUR) unless otherwise specified
• Payment is due immediately upon purchase or subscription
• You authorize CampaignKit to charge your payment method for all fees incurred
• You are responsible for providing accurate payment information

5.4 Refund Policy

CampaignKit does not currently offer refunds, either partial or in full. All sales are final. However, we may consider refund requests on a case-by-case basis in the event of:

• Significant service outages or failures caused by CampaignKit
• Duplicate charges or billing errors
• Extraordinary circumstances at our sole discretion

To request a refund consideration, contact support@campaignkit.cc within 7 days of the charge.

5.5 Subscription Cancellation

You may cancel your monthly subscription at any time. Upon cancellation:

• You will retain access to paid features until the end of your current billing period
• No refunds will be issued for partial months
• Your account will revert to the free tier at the end of the billing period

5.6 Price Changes

CampaignKit reserves the right to change pricing at any time. For existing subscriptions:

• We will provide at least 30 days' notice of price increases
• New pricing will apply at your next renewal date
• You may cancel your subscription before the new pricing takes effect

6. Service Accuracy and Limitations

6.1 Best Efforts Basis

CampaignKit will make reasonable efforts to provide accurate email validation results. However, we do not guarantee 100% accuracy due to:

• Email server configurations and anti-verification measures
• Temporary network issues or email server downtime
• Catch-all email server configurations that accept all addresses
• Disposable email services that frequently change domains

6.2 No Warranties

The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

6.3 Rate Limits

To ensure fair usage and service availability, CampaignKit enforces rate limits on API requests and bulk validation operations. Excessive usage may result in temporary throttling or account suspension.

7. Data Privacy and Security

7.1 Data Collection

When you use the Services, we collect email addresses you submit for validation. Our data practices are detailed in our Privacy Policy.

7.2 No Sale of Data

CampaignKit will never sell your data to third parties. We do not monetize email addresses submitted for validation.

7.3 Data Retention

• API Validation Logs: Retained for 90 days for service quality and fraud prevention
• Demo Tool Data: Not stored permanently; logs retained for 30 days
• Account Data: Retained for the duration of your account plus legal retention requirements

8. Intellectual Property Rights

8.1 Service Ownership

The Services, including all content, features, functionality, software, algorithms, and technology, are owned by CampaignKit and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your internal business purposes in accordance with these Terms.

8.3 Restrictions

You may not:

• Copy, modify, or create derivative works of the Services
• Reverse engineer, decompile, or disassemble the Services
• Remove or alter any proprietary notices from the Services
• Use the Services to build a competing service

9. Service Modifications and Availability

9.1 Changes to Services

CampaignKit reserves the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice. Changes may affect:

• Pricing and pricing policies
• Features and functionality
• Access restrictions and rate limits
• API endpoints and integration methods
• Data retention policies

9.2 Service Availability

While we strive for high availability, we do not guarantee uninterrupted access to the Services. Maintenance, updates, and unforeseen issues may cause temporary service disruptions.

9.3 No Liability for Changes

CampaignKit shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Services.

10. API and Integration Terms

10.1 API Access

Access to our API is subject to:

• Valid API authentication credentials
• Compliance with rate limits and usage restrictions
• Adherence to API documentation and best practices

10.2 API Keys

You are responsible for maintaining the confidentiality of your API keys. If you believe your API key has been compromised, contact us immediately.

10.3 Third-Party Integrations

Integrations with third-party platforms (HubSpot, Mailchimp, etc.) are subject to those platforms' terms of service. CampaignKit is not responsible for issues arising from third-party platform changes or discontinuations.

11. Limitation of Liability

11.1 Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAMPAIGNKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11.2 Damages Cap

IN NO EVENT SHALL CAMPAIGNKIT'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO CAMPAIGNKIT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

11.3 Essential Purpose

The limitations in this section apply even if any remedy fails its essential purpose.

12. Indemnification

You agree to indemnify, defend, and hold harmless CampaignKit, its officers, directors, employees, contractors, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of applicable laws or regulations

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting support@campaignkit.cc or canceling your subscription through your account settings.

13.2 Termination by Us

We may suspend or terminate your access to the Services immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Fraudulent activity or payment disputes
• Violation of the Acceptable Use Policy
• Use of the Services for illegal activities
• Prolonged inactivity

13.3 Effect of Termination

Upon termination:

• Your right to access and use the Services will immediately cease
• We will delete your account data within 30 days, except as required by law
• You remain liable for all charges incurred prior to termination
• Sections that by their nature should survive termination will survive

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany, without regard to its conflict of law provisions.

14.2 Jurisdiction

Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in Germany.

14.3 Informal Resolution

Before filing a legal claim, you agree to attempt to resolve the dispute informally by contacting us at support@campaignkit.cc.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and CampaignKit concerning the Services.

15.2 Amendments

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date at the top of this page
• Sending email notification for significant changes (for registered users)

Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

15.3 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15.4 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

15.5 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

15.6 Force Majeure

CampaignKit shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, natural disasters, or internet service failures.
